The $206 billion Master Settlement Agreement (MSA) with the Tobacco Industry has given rise to numerous legal issues which are handled by the Tobacco Enforcement Section.

Primary roles of the Tobacco Enforcement Section include monitoring compliance with the payment provisions in the MSA; enforcing restrictions placed upon the Tobacco Industry in the areas of marketing, advertising, promotions, and sponsorship; working to make current laws dealing with tobacco issues work more effectively; and, defending the MSA and other tobacco legislation against court challenges.

Family Smoking Prevention and Tobacco Control Act

Pursuant to § 907, after September 22, 2009, a cigarette or any of its component parts shall not contain an artificial or natural flavor (other than tobacco or menthol) or an herb or spice that is a characterizing flavor of the tobacco product or tobacco smoke. Instructions for Department of Revenue (DOR) DAS-95 & REV-1808 Forms

Cigarette Stamping Agent (CSAs) should continue to submit documents directly to both DOR and to the OAG’s Tobacco Enforcement Section (TES) with specific information for each agency.

TES submissions specifically, for the monthly Non-Participating Manufacturer (NPM) cigarette (DAS-95) and Roll Your Own (RYO, REV-1808) reporting should include:

PA’s Electronic Nicotine Delivery System (ENDS) Directory

Act No. 57 of 2025, which was signed by Governor Shapiro on December 22, 2025, establishes a directory of electronic nicotine delivery system (ENDS) products that may be sold in the Commonwealth. The Department and the Attorney General are empowered to enforce Act 57, and the Attorney General is responsible for administering the ENDS directory.

Pennsylvania RYO Certification Schedule

  • Certifications are currently being accepted. Certify early to ensure inclusion on the Directory. RYO brands are currently being certified and will added to the Directory upon approval.
  • Certification Forms due by January 28, 2017
  • RYO brands must be added to the Directory by March 14, 2017
  • All non-certified RYO brands will be deemed contraband and subject to seizure on March 28, 2017
