Agreement Finalized to Enable Free Access to Medical Records for Thousands of Crozer Health Patients

Patients will need records as they seek care options, following closure of Crozer system

HARRISBURG — Attorney General Dave Sunday announced that an agreement has been finalized that ensures free access to personal medical records for thousands of patients — including Medicaid patients — formerly treated at Crozer Health hospitals.

During a federal bankruptcy court hearing Wednesday regarding Prospect Medical Holdings’ closure of the Crozer system, an order was signed by the court that will spare patients of per-record fees.

Patients who formerly were treated at the Delaware County-based Crozer system are in the process of finding new providers, and should have their medical records during that process.

“This resolution will have significant impact for patients who otherwise could encounter hundreds of dollars in fees for necessary records,” Attorney General Sunday said. “Those costs would only add to the stress and inconvenience for many Pennsylvanians searching for care options following Prospect’s closure of the Crozer system. Our office worked to minimize the financial burden for thousands of impacted Pennsylvanians by bringing this matter before the court last month.”

The Office of Attorney General recently notified the presiding court that Crozer patients — including Medicaid patients — were encountering fees to acquire their medical records. The Office of Attorney General cited federal and state law that regulates fees for medical records, which led to the resolution.

Under the agreement, the Foundation for Delaware County will commit $3 million to fund expenses related to records acquisitions for up to 43,000 patients. Patients who previously paid for records will not be reimbursed.
