AG Sunday Announces $200 Million Deposited into the Commonwealth’s General Fund as a Result of the Joint Underwriting Association Litigation

HARRISBURG — Attorney General Dave Sunday announced that a $200 million transfer of funds today reached the Commonwealth of Pennsylvania’s general fund — the sum being the result of the Office of Attorney General’s victory in years-long litigation against the Pennsylvania Professional Liability Joint Underwriting Association (JUA).

Since 2017, the Office of Attorney General’s Civil Litigation Section has been engaged in argument over a multi-million dollar surplus balance carried by the JUA, which was created by the Pennsylvania General Assembly in 1975 as an insurance option for high-risk medical providers.

The Office of Attorney General has argued the JUA — being created by the General Assembly — is a public, not private, entity. A federal court recently ruled in the Office of Attorney General’s favor, freeing up the transfer of $200 million to the general fund.

“Today is a proud day, as the Commonwealth received $200 million for budgetary needs thanks to the tenacious advocacy of our office, which, for years, fought on behalf of Pennsylvanians to take ownership of this money,” Attorney General Sunday said. “It has been a long road, and I commend our civil litigators for seeing it through to this end result — a monumental victory for Pennsylvanians.”

The impetus for the litigation was Act 44 of 2017, which ordered the transfer of $200 million from JUA to the Commonwealth general fund. JUA then filed suit against the Governor and Insurance Commissioner, who the Office of Attorney General has represented in the matter.
