HARRISBURG — Attorney General Dave Sunday announced charges against an Allegheny County man regarding delivery of a fatal batch of fentanyl/heroin that caused a man’s death in March 2025.

Scott Township police, assisted by the Office of Attorney General’s Bureau of Narcotics Investigation, charged 40-year-old Brennon Ely with felony drug delivery resulting in death, possession with intent to deliver, and related offenses. Ely was recently taken into custody at his Pitcairn home and is awaiting arraignment.

Investigators determined Ely provided fentanyl/heroin — in bags stamped “Carlitos Way” — to a Scott Township man, who was found dead in his home.

“Those who deal deadly poisons for profit will be held accountable for the heartache and devastation they cause,” Attorney General Sunday said. “With our partners, we determined this defendant provided the fatal fentanyl dose that took the life of a father.”

Police responded to the decedent’s home and found the man dead, along with fentanyl/heroin bags stamped “Carlitos Way.”

Investigators analyzed cellphone data and used other tactics to arrange a drug deal with Ely, who sold fentanyl/heroin to an undercover agent — Ely brought a small child along for the transaction.

Agents arrested Ely and later searched his vehicle, uncovering a brick of fentanyl/heroin, with the “Carlitos Way” stamps.

The Allegheny County District Attorney’s Office will prosecute the case. Criminal charges, and any discussion thereof, are merely allegations and all defendants are presumed innocent until and unless proven guilty.
