AG Sunday Sues Western Pa. Home Contractor for Failures to Complete Projects or Offer Refunds

HARRISBURG — Attorney General Dave Sunday announced a lawsuit against a western Pennsylvania-based home improvement contractor for failures to fulfill contracts with consumers. 

The lawsuit accuses A&S Contracting and Roofing, LLC, and its owner, Stephen Spallone, of violating Pennsylvania’s Consumer Protection Law and Home Improvement Consumer Protection Act by abandoning projects after obtaining more than $56,000 in deposits from consumers. The lawsuit also alleges A&S used non-compliant contracts with consumers. 

The lawsuit seeks to permanently prevent A&S Contracting & Roofing, LLC, from doing business as a home improvement contractor in Pennsylvania, as well as pay consumer restitution in the form of refunds, civil penalties, and costs. 

“This contractor took large sums of money from Pennsylvanians wanting to improve their homes, then turned his back on them,” Attorney General Sunday said. “Our Bureau of Consumer Protection will adamantly advocate for homeowners whose dreams of property upgrades and additions are ruined by neglectful contractors.”

Any consumers who believe that they or someone they know may be a victim of the business practices of A&S Contracting & Roofing or its owner, Stephen Spallone, should file a complaint with the Bureau of Consumer Protection online, call 1-800-441-2555, or email sc***@*************al.gov.

According to the lawsuit, six consumers filed complaints with the Bureau of Consumer Protection alleging that they paid A&S Contracting & Roofing thousands of dollars in down payments for home improvement projects such as roofing and gutter replacement, construction of decks and patios, and siding replacement. A&S Contracting & Roofing failed to complete these home improvement projects, and in some instances, performed no work following the collection of a deposit. 

The complaints received range from 2021 through 2024 and impacted consumers residing in Allegheny, Beaver, Butler, and Indiana Counties. 

In one instance the consumer entered into a contract with A&S for a total contract price of $48,000 for a roof replacement, siding replacement, and porch construction. This consumer paid A&S an initial deposit of $28,000. A&S informed the consumer that they would give the consumer a written contract by the following day. However, A&S Contracting & Roofing never returned to the consumer’s home. The work was never started, and the consumer still has not been refunded the entire initial deposit. 

Inspectors, contractors, laborers, suppliers, or anyone else who may have information regarding the business practices of A&S Contracting & Roofing, LLC, or Stephen Spallone are also encouraged to contact the Bureau of Consumer Protection.
