HARRISBURG – Attorney General Dave Sunday is advising Pennsylvania consumers that the deadline to file proof of claims in the 23andMe bankruptcy case is July 14, 2025. Consumers may be eligible to file a proof of claim if their personal and/or genetic information was exposed in a 2023 data breach.
Additionally, consumers may wish to delete their profiles and accounts with 23andMe to ensure their personal data is erased from the 23andMe system and not sold as part of the bankruptcy process.

“My office is not directing all 23andMe consumers to delete their accounts, but we encourage those consumers to consider such action as there are some uncertainties as to what will happen to the very sensitive data and information obtained by the company,” Attorney General Sunday said. “Pennsylvanians should be aware of a potential sale of their information as part of the bankruptcy process.”
The Pennsylvania Office of Attorney General took action to have a consumer protection ombudsman in place during the process to review security polices. The court-appointed overseer will also monitor how a sale would impact customer data on file.
On March 23, the genetic testing and information company filed Chapter 11 bankruptcy in the United States Bankruptcy Court for the Eastern District of Missouri. Under a Chapter 11 bankruptcy, consumers’ genetic data may be considered an asset that could be sold to a potential buyer in the bankruptcy process.
As outlined in the Frequently Asked Questions page on the 23andMe bankruptcy administration website, “Customers still have the ability to delete their data and 23andMe account.”
Consumers with 23andMe accounts can delete both their accounts and personal genetic data with the following steps:
To Delete Genetic Data from 23andMe
- Log into your 23andMe account.
- Go to the “Settings” section of your profile.
- Scroll down to a section labeled “23andMe Data” at the bottom of the page.
- Click “View” next to “23andMe Data.”
- Download your data if you’d want to retain a copy of your genetic data for personal storage.
- Scroll down to the “Delete Data” section.
- Click “Permanently Delete Data.”
- Confirm your request by following the instructions emailed to you by 23andMe. You must confirm the request to have your data removed.
To Destroy Your 23andMe Test Sample
If you previously opted to have your saliva sample and DNA stored by 23andMe, but want to change that preference, you can do so from your account settings page, under “Preferences.”
To Revoke Permission for Your Genetic Data to be Used for Research
If you previously consented to 23andMe and third-party researchers to use your genetic data and sample for research, you may withdraw consent from the account settings page under “Research and Product Consents.”
