ASSET PURCHASE AGREEMENT

I PURCHASED FURNITURE FROM A LEVIN FURNITURE OR LEVIN MATTRESS STORE AND DID NOT RECEIVE MY FURNITURE OR A REFUND – IS THERE AN UPDATE ON THE BANKRUPTCY?

For customers (including those who have already filed a claim in the Debtors’ bankruptcy cases) who have made deposits or paid in full for merchandise purchased from the affected stores, and who did not receive such merchandise, on May 27, 2020, the U.S. Bankruptcy Court for the District of Delaware approved the sale of assets at the Levin stores back to Robert Levin through his companies, Levin Furniture, LLC and Levin Trucking, LLC.

Those customers will be eligible for certain additional relief beyond that which is available through the bankruptcy court proof of claim process.

WILL I BE NOTIFIED IF I AM ELIGIBLE?

Yes. 

HOW AND WHEN WILL I BE NOTIFIED?

The closing on the sale is expected to take place by mid-June.  Following the closing, the Trustee will notify all eligible customers in writing that they may submit a claim to the Trustee.

WHAT OPTIONS WILL I HAVE ONCE I RECEIVE THE NOTICE FROM THE TRUSTEE?

The instructions, information required and your options will be contained in the notification from the Trustee.  As currently contemplated and approved by the bankruptcy court, you will be given three (3) options:

(1) request to fulfill your order by obtaining the previously ordered furniture and delivering the same to you giving credit of the full amount of such deposit to such order so long as the merchandise is available; or

(2) request to provide you with store credit or a gift card in an amount not less than the full amount of your deposit; or

(3) a cash refund, for at least part of your deposit.

I BOUGHT FURNITURE AT A WOLF FURNITURE STORE – WILL I BE ELIGIBLE FOR RELIEF THROUGH THIS SALE?

No.  Only Levin customers will be eligible for relief through this asset sale at this time.  Wolf Furniture customers can still attempt to initiate chargebacks on their credit cards and can proceed with their interests in bankruptcy court.
