ENDS Directory List

PUBLICATION OF ENDS DIRECTORY LIST:  Under the ENDS Directory Law, 72 P.S. §206-I(g), by June 20, 2026, the Attorney General is to make available on its public website “a directory that lists all manufacturers of electronic cigarettes that contain nicotine . . . for which certification forms have been submitted and approved by the Attorney General and shall update the directory at least monthly to ensure accuracy.”

The attached spreadsheet, PA ENDS Directory, is the Attorney General’s directory list.  However, no manufacturer of electronic cigarettes that contain nicotine has yet been approved for listing on the directory.  The Attorney General currently has 23 manufacturer certifications that are under review.  The directory list will be updated as manufacturers and their products are approved. Information submitted by manufacturers as part of the certification process, including the identity of manufacturers and the products for which they are seeking certification, is treated as confidential.  Information is disclosed on the public directory list only upon certification approval and only to the extent required for listing, unless authorized by the manufacturer or otherwise required by law or court order.  72 P.S. §206-I(e).

Pending Certification Status:  The attached spreadsheet, ENDS Manufacturers with Pending Certifications, includes the names of manufacturers that have authorized us to list their pending status, and, if authorized to be listed, those products for which they have requested approval.  The listing of pending certification status is not, and should not be considered to be, indicative of whether the certification meets statutory requirements or that substantive review has been conducted or completed.  The absence of a manufacturer or their products from this list does not necessarily mean that a particular manufacturer has not submitted a certification that is under review; it may only mean they have not authorized listing of their pending status.

No Change in Enforcement Date:  As indicated in the Attorney General’s Frequently Asked Questions page, the date when enforcement of the prohibitions against retail sales and retention of inventory by wholesalers and retailers for retail sales in the Commonwealth is October 19, 2026.  72 P.S. §206-I(n).  The fact that no manufacturer of electronic cigarettes that contain nicotine, or their products, has yet been approved does not change this enforcement date, which is established by statute.
