HARRISBURG — Attorney General Dave Sunday announced that a Philadelphia court has ordered the CEO of ABC Capital to pay a $350,000 penalty to the Commonwealth for breach of a settlement agreement with the Office of Attorney General.
An Office of Attorney General investigation revealed violations of Pennsylvania law regarding management and maintenance practices at Philadelphia rental properties by Jason Walsh and the companies he controls. An agreement was reached in the form of an Assurance of Voluntary Compliance filed with the Philadelphia Common Pleas Court in April 2024 that prohibited Walsh from managing and residential rental properties in Pennsylvania.
Walsh is CEO of ABC Capital Realty, LLC, and affiliates; Giovanni Real Estate, LLC; IPP USA, LLC; and Premier Rentals Philadelphia Limited.
This week, the Philadelphia Court of Common Pleas ruled that Walsh violated the agreement by managing properties and contacting tenants, among other things.
“We are grateful that the Court recognized blatant breaches of this agreement, and imposed a serious penalty against Mr. Walsh,” Attorney General Sunday said. “We will continue to hold Mr. Walsh accountable under this agreement that clearly prohibits him from managing residential properties in the Commonwealth.”
The settlement, in the form of an Assurance of Voluntary Compliance, regarded allegations that Walsh did not consistently repair or maintain residential properties in habitable conditions; did not obtain rental licenses as required by applicable laws in Philadelphia; and engaged in other inappropriate and unlawful conduct which allegedly resulted in deceptive and unfair treatment of tenants in rented homes.
The Court found that Walsh violated the agreement by performing property management services for a property he owned in Philadelphia; failing to use a professional property manager; providing inaccurate information to the Office of Attorney General; and communicating directly with tenants.
Walsh was ordered to immediately pay $350,000 to the Commonwealth.
