Impacted Consumers are Encouraged to File Complaints with the Office of Attorney General
HARRISBURG – Attorney General Dave Sunday announced a lawsuit against home improvement contractor Michael Davis and his Philadelphia-based 1st Choice Roofing, Inc., regarding shoddy work and failures to issue refunds to unsatisfied consumers.
The Office of Attorney General’s lawsuit also alleges that 1st Choice Roofing did not abide by the Home Improvement Consumer Protection Act, and that its contracts lacked essential items, such as a Notice of Cancellation, work duration terms, and insurance information.
The Office of Attorney General’s Bureau of Consumer Protection received numerous consumer complaints against the business, and is encouraging any additional consumers harmed by the company to file a complaint.
”Home upgrades improve quality of life and instill a sense of pride in homeowners. In these cases, consumers dealt with subpar work and were ignored when they requested refunds,” Attorney General Sunday said. “My Bureau of Consumer Protection is dedicated to protecting the rights of Pennsylvanians who are harmed by bad business practices.”
Consumers who may have been impacted by the business dealings of 1st Choice Roofing or Michael Davis should file a complaint with the Office of Attorney General online, by phone at 1-800-441-2555, or by email at scams@attorneygeneral.gov.
Consumers who filed complaints reported shoddy or incomplete work and unfulfilled refund requests. One consumer paid a $500 deposit for chimney work that was never started and their refund requests have been ignored.
The lawsuit asks that the Court require Davis and 1st Choice Roofing, Inc., to refund any impacted consumers for payments made but not returned; to pay any penalties as required by law, and to pay any costs associated with the investigation and litigation; as well as finding Davis and 1st Choice Roofing in violation of the Home Improvement Consumer Protection Act and ordering the business to comply with the law.
This lawsuit was filed in the Philadelphia County Court of Common Pleas by Senior Deputy Attorney General James S. Wise and is pending acceptance by the Court.
