ACRE / ACT 38 Farm Ordinance Review

A new law which took effect on July 6, 2005 allows farm owners or operators to ask the Attorney General to review local ordinances that they feel restrict normal agricultural operation or ownership.

The law also gives the Attorney General the authority to file a lawsuit in Commonwealth Court to challenge the legality of some ordinances, if the review determines they may be in violation of state law.

The Office of Attorney General will respond to each request within 120 days.

Requests for review should be sent, in writing, to the following address:

Requests for review should include a copy of the ordinance, a short explanation of any objections that a farm owner or operator has to the ordinance, and any other materials that will aid the Attorney General's review.
